This statement sets out the Terms of Use for the ‘Bicker Manor’ beta trial available online at www.bickermanor.com on BT Vision and your mobile phone. We will refer to these as the Bicker Manor Websites. The joint owners and controllers of the Bicker Manor websites are BT and The University of Nottingham (both these companies being referred to jointly as “we” or “us”).
We invite you to participate in a beta trial called ‘Bicker Manor’ , exploring how User Generated Content (UGC) can be encouraged and used in sustainable campaigns and events. Bicker Manor is an experimental communication media trial which aims to understand how UGC can support an interactive campaign which spans web, mobile and BT Vision’s IP (Internet Protocol) TV service.
‘Bicker Manor ‘is part of a research project called PARTICIPATE, which is part-funded by the Engineering and Physical Sciences Research Council and the Technology Strategy Board. Project partners include; BT, the BBC, Microsoft Research, Nottingham University, Bath University and ScienceScope, with contributions from Blast Theory. ‘Bicker Manor’ is a beta trail and is not a commercial product. As such there may be times where you experience some technical problems and we cannot guarantee that it will be fault free. Your participation and feedback will help inform our research.
Bicker Manor and the materials posted to the websites are available for entertainment purposes only. We do not guarantee the accuracy of information on the websites.
Due to the experimental nature of ‘Bicker Manor’, it may need to be withdrawn, but we will try to keep you informed or any changes if it is practical to do so. We aim to run the beta trial for approximately three weeks, but owing to the nature of a technology trial this may also be subject to change.
To take part in the Bicker Manor beta trial, you will need to register as a player. These Terms of Use are accepted upon your registering to use the Bicker Manor Websites.
Bicker Manor will involve:
• Taking part in an interactive experience running on web, mobile and BT Vision, according to your preferences.Please understand that this is a trial of the technologies we have created and the experience it provides.
As part of the Bicker Manor trial you will be asked to take up residence with the Bickers, a fictitious family who take you on a journey that playfully challenges the impact your life has on the environment.
Bicker Manor invites you to:
• Post and view ‘user generated content’ in the form of and not limited to text, numbers, digital images and videos, in response to a series of questions or missions posed to you. You will be able to view user generated content from other registered players on the Bicker Manor websites. Non-registed users will be able to view selected user generated content on the public pages.
• Take part in offline activites. Offline activities may involve doing things around your home or at work or when you are out and about. Some examples are: recording your point of view, measuring energy use, demonstrating an idea or activity. This list is not extensive and we may change or add to these in the duration of the trial. We will ask you in some cases to record digital images and videos of these activities to post online.
• You are free to take part in as many or as few activities as you wish.
Bicker Manor is free to play on the web.
If you choose to play using your mobile phone you will receive SMS messages from the Bicker Family as part of the game. You will be able to send SMS responses or use MMS messages to send video and images to the Bicker Manor websites. If you choose this option your standard network rates will apply and you agree to pay for messages you send to Bicker Manor. If you are not the bill payer please make sure you have the bill payers’ permission to do so.
To access Bicker Manor on BT Vision you will need to be an existing BT Vision customer. There are no additional charges for taking part on BT Vision. Not all website capabilities will be available on the BT Vision Bicker Manor browser.
Capabilities of the Bicker Manor websites may change over the period of the trial as we try to improve the experience.
To take part in Bicker Manor we ask you to sign up (register). If you do not wish to be bound by the Terms of Use you should not register to use the Bicker Manor websites. We may modify these Terms of Use from time to time and such modification shall be effective upon posting on the Bicker Manor websites. You agree to be bound by any changes to the Terms of Use when you enter the Bicker Manor websites after any such modification is posted.
Please be careful about any information you post on the Bicker Manor Websites and that you make accessible to others. When you register you are asked to provide a nickname and an image which will be public.
Your user profile must not include the following:Telephone numbers, post code, and last names of any person other than you. Any photographs or digital images posted by you must not contain any offensive subject matter, such as, but not limited to, nudity or violence and must comply with all of the other provisions set out in these Terms of Use.
By using the websites you agree that all the information you submit is truthful and accurate and that you agree to maintain the accuracy of such information. To register for an account you confirm that you are 14 years of age or older. Younger participants should take part only with their parent or guardian’s permission and the account should be held and managed by the parent or guardian. You are solely responsible for all content published or displayed through your Bicker Manor account, including any messages you send, and for your interactions with other registered players.
Personal Content is the user generated content you post to the Bicker Manor websites. This includes but is not limited to text, audio, visual or audio visual content, information, messages, photos or public profiles.
By participating in Bicker Manor you agree that:
You are soley responsible for the Personal Content that you post on the Bicker Manor Websites and that you own the Personal Content posted by you to the Bicker Manor websites.
Your Personal Content does not breach any privacy rights, publicity rights, copyright rights, moral rights, or other intellectual propery rights of any third party. You agree to pay all royalties and fees owing to any person for any Personal Content you post on the Bicker Manor websites.
You may not post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietry information without the prior consent of the owner.
The following is a partial list of the kind of Personal Content that is illegal or prohibited on the Bicker Manor Websites: any posting that contains material which: (a) is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; (b) harasses or advocates harassment of another person; (c) involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming"; (d) promotes information that you know to be false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous or which infringes any rights of any third party; (e) promotes an illegal or unauthorised copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files; (f) contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page); (g) provides material that exploits people in a sexual or violent manner, or solicits personal information from anyone under 18; (h) provides instructional information about illegal activities such as making or buying illegal weapons, breaching someone's privacy, or providing or creating computer viruses; (i) solicits passwords or personal identifying information for commercial or unlawful purposes from other users; or (j) involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes.
Please ensure you have the consent of anyone who is identifiable in your images and videos.
Your Personal Content, including your images, videos, messages and answers to questions are intended to be shared with other players on the Bicker Manor websites, and selected content will also be viewed in public sections of the sites. Also we will want to write about the user trial and promote the results and will need to illustrate this with examples of how people took part.
When you make videos and images and post these to the site they will appear in your media folder. You can delete this media before you link it to a mission. Your media only becomes public when you link it to a mission and this is the media that we will publically display.
By posting your Personal Content on the Bicker Manor websites you grant BT and the University of Nottingham the non-exculsive, fully paid worldwide licence to use, copy, publicly perform and display and communicate such Personal Content on the Bicker Manor websites.
You also give permission to BT and The University of Nottingham to use the Personal Content you post within publicity material, research publications, conferences and presentations about the trial.
You retain the copyright for your Personal Content.
We will remove material upon prompt notification to BT or the University of Nottingham by the copyright or intellectual property right owner.
We retain the right to review, and delete any Personal Content that in our sole judgement of breaches the Terms of Use, or which may be offensive, undesirable, illegal, harmful or breach the rights of others, or theaten the safety of any Bicker Manor registered player, or the general public.
We may delete your pofile and account without warning if it has been found that you have breached the Terms of Use.
You must use the Bicker Manor Websites in a manner consistent with any and all applicable laws and regulations. You agree not to and acknowledge that it would be a breach of these Terms of Use to:
• impersonate another person or use a false name or a name you are unauthorised to use, or create a false identity or origin or e-mail address or try to mislead us or others as to identity or origin of any communications or to provide inaccurate or unreliable contact details;
• modify, access or make available data stored on a computer or device which you have accessed through our network, when either: the owner of the data, computer or device has taken steps to prevent you from doing this; or the owner has expressed a wish that you do not do this;
• make available or upload files that contain software or other material, data or information not owned by or licensed to you or collect information about others (eg. names/addresses) without their prior consent;
• damage, interfere with or disrupt access to the Bicker Manor Websites or do anything which might impair their functionality;
• use the Bicker Manor Websites in any way to send unsolicited (commercial or otherwise) e-mail ("Spam") or any material for marketing or publicity purposes, or any similar abuse of either;
• publish, post, distribute, disseminate or otherwise transmit, defamatory offensive, infringing, obscene, indecent or other unlawful or objectionable material or information or material or information that infringes the rights of any third party;
• make available, upload or distribute by any means any material or files that contain any viruses, bugs, corrupt data, "trojan horses", "worms", spyware or any other harmful software;
• falsify the true ownership of software or other material or information contained in a file made available via the Bicker Manor Websites;
• obtain or attempt to obtain unauthorised access, through whatever means, to the Bicker Manor Websites;
• use any information obtained from the Bicker Manor Websites in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any registered player without their prior explicit consent. You may not use the account, username, or password of another registered player at any time nor may you disclose your password to any third party or permit any third party to access your account; or sell or otherwise transfer your profile.
Information we may collect from you:
• When you register you are asked to provide a nickname, your first and last name, your age, postcode and a profile picture. You will also need to provide an email address for us to complete your registration. You will have the option to add your mobile phone number.
• We may ask you to complete a questionnaire that we use for research purposes, although you do not have to respond.
• We may also collect details about your interactions with the Bicker Manor game via the websites and phone (“Usage Data”) including but not limited to IP address, profile information, aggregate user data, traffic data and browser type.
• You nickname and profile picture will be public for others to view.
• Your name and email address provided at registration will be used to administer your account.
• We may customise the content you see and the messages you receive, based on the details given by you at registration, and in response to your activity on the Bicker Manor websites.
• Usage Data is used to manage the Bicker Manor websites and track usage.
• User IP addresses may be recorded for security and monitoring puposes.
• Email and mobile phone numbers are used to send updates from the characters in the game if you have opted to do so.
• Collated responses to questions and activities will be used to provide feedback to players in the game. For example, 30% of people answered ‘D’ in a multiplpe choice question.
• Statistical analysis of features of the game for research purposes. For example we may find that only 20% of people use the rating function on the website, or decided to play a certain mission.
• To contact you for permission to use of your Personal Content for other purposes than those already identified.
• We will not use the information collected for marketing or to sell you things.
To Whom Will Your Information Be Disclosed:
• Research staff at BT and the University of Nottingham in order to administer Bicker Manor.
• We may present the statistical data collected from this trial and/or Personal Content within research publications, conferences or presentations. While we may make the results of this study publicly available, no personal information directly relating to you will be used.
• Except as otherwise described in the Terms of Use, we will not disclose personal information to any third party unless we believe that disclosure is necessary: (1) to conform to legal requirements or to respond to a summons, search warrant or other legal process; (2) to enforce the Bicker Manor Terms of Use or to protect our rights; or (3) to protect the safety of members of the public and users of the service.
The time period for which we keep information varies according to what the information is used for. In some cases, there are legal requirements to keep data for a minimum period. Unless there is a specific legal requirement for us to keep the information, we will retain it for no longer than is necessary for the purposes for which the data was collected or for which it is to be further processed.
You may modify some of your personal information at any time by logging into your account and accessing some of the features that will allow you to edit your Profile Information. At present you are able to change your profile image, contact details and how and if we send you messages. The Bicker Manor Website may use cookies to store visitors' preferences and to record session information to better the visitors' experience and personalise the Bicker Manor Website experience. You may disable cookie support on your browser but be aware that by doing so, you will lose certain features that require a cookie to work properly. We may use the information collected by the cookie to provide us with various statistics without identifying any individual.
Bicker Manor user accounts are secured by use-created passwords and precautions are taken to ensure that user account information is kept private. We use appropriate organisational and technical measures to protect use information that is stored within our database, and we restrict access to use information to those employees who need access to it in order to perform their job functions, such as our customer service personnel and technical staff. Please note that we cannot guarantee the security of member account information. Unauthorised entry or use, hardware or software failure, and other factors may compromise the security of member information at any time despite the efforts we may take to protect it.
The Bicker Manor Websites and all the content on the sites are owned by or licensed to BT and The University of Nottingham or the Participate Project Partners. Content includes but is not limited to text, graphics, photos, logos, button icons, images, aduio and audio visual clips, digital downloads, databases and data complications, and software.
You may view the Bicker Manor Websites on your computer screen, mobile phone or television and print their contents on your printer for your personal and non-commercial use only. For the avoidance of doubt, anything printed will form part of the Content as defined above.
Without BT and Nottingham University's written consent, you may not use, transfer, copy or reproduce any part of the Content, the Bicker Manor Websites or their source HTML code in whole or in part, in any form or by any means, electronic, mechanical or otherwise, except for the sole purpose of viewing their content. This includes electronic reproduction by uploading or downloading and any means of communicating them to other members of the public.
Without BT and Nottingham University's written consent, you must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
You warrant that it is legal for you to view the Bicker Manor Websites and the Content in the jurisdiction to which you are subject. You are responsible for compliance with all laws of that jurisdiction, in viewing or using the Content.
Our researchers have created missions for your entertainment on environmental topics. These are editorial pieces of content which combine fictional elements and commonly available information on specific topics from public sources. Whilst attempts have been made to check that these are up to date and from reliable sources, the editorial material may contain innaccurate information. Neither BT not The University of Nottingham assume responsibility or liability for this material.
Information provided by other Bicker Manor registered players may contain innaccurate, inappropriate or offensive material, products or services. While we ask that all posted information be accurate, neither BT nor The University of Nottingham assume responsibility or liability for this material.
Neither BT nor The University of Nottingham assume any responsibility for the conduct, whether online or offline, of any user of the Bicker Manor Websites.
The Bicker Manor Websites may contain links to websites operated by parties other than BT or the University of Nottingham ("Third Party Websites"). BT and The
University of Nottingham are not responsible for the content of external internet sites.
Please do not endanger yourself or others, take any unnecessary risks or break any laws when participating in the Bicker Manor beta trial. You agree that you use the Bicker Manor Websites and participate in missions at your own risk.
By participating in any Bicker Manor online or offline event, you agree to release and hold BT and The University of Nottingham harmless from any and all losses, damages, rights, claims, and actions of any kind including but not limited to property damage, either directly or indirectly related to or arising from your participation in any such Bicker Manor event. Notwithstanding anything in these Terms of Use, neither BT nor The University of Nottinham disclaim liability for death or personal injury caused by their own respective negligence.
Neither BT nor Nottingham University assume any responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, any user communication.
Neither BT nor the University of Nottingham are responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, mobile phone, software, failure of any email or players due to technical problems or traffic congestion on the Internet or at any Bicker Manor Website or combination thereof, including any damage to users and/or Members or to any person's computer or mobile phone related to or resulting from participation or downloading materials in connection with the Bicker Manor Websites.
While certain precautions have been taken to detect computer viruses and ensure security, we cannot guarantee that the Bicker Manor Websites are virus-free and secure. Neither BT nor The University of Nottingham shall be liable for any loss or damage which occurs as a result of any virus, distributed denial-of-service attack, breach of security or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Bicker Manor Websites or to your downloading of any material posted on them, or on any website linked to them.
